The present petition has been filed by the petitioners seeking setting aside of judgment and order dated 29.05.2023 by the learned Central Administrative Tribunal, Principal Bench, New Delhi in O.A.3941/2016, whereby petitioners have been directed to forward dossiers of the respondent and to consider her case for the post for the year 2013 and to offer appointment, if found eligible. Direction has also been issued to grant consequential benefits including seniority, notional fixation of pay from the date the immediate juniors in the merit list were appointed. 2.

Learned counsel appearing on behalf of the respondent has informed this Court that the issue raised in the present petition has already been decided vide decision dated 24.01.2024 & 21.02.2024 in W.P.(C) 10718/2016 in the case of Devender Yadav and Ors Vs The Secretary Delhi Subordinate Services Selection Board and Ors. It is further submitted by learned counsel for the respondent that the respondent herein is similarly situated to the aforementioned case of Devender Yadav and Ors (supra) as well as in the case of Delhi Subordinate Services Selection Board (DSSSB) and Anr. Vs Amit Kumar and Ors., in W.P.(C) 6802/2024, which was decided by this Court on 13.05.2024.

Learned counsel appearing on behalf of the petitioners, on instructions, submits that the aforesaid cases are no doubt situated as per the Delhi Subordinate Services Selection Board (DSSSB) and Anr Vs Amit Kumar and Ors., in W.P.(C) 6802/2024.

It is also not in dispute that The Secretary Delhi Subordinate Services Selection Board Govt. N.C.T Delhi challenged the judgment dated 21.02.2024 Devender Yadav and Ors (supra) in Special Leave Petition (C) No.7954/2024 and the same was dismissed vide judgment and order dated 29.04.2024. Thus, the case of Devender Yadav and Ors (supra) attained finality. It is also not in dispute that the respondent herein is similarly situated to those mentioned in cases in the aforesaid petitions. 6.

In view of the above, the respondent being similarly situated, we find no ground in the present petition. The same is accordingly dismissed. Pending applications also stand disposed of.
