The petitioner is invoking the writ jurisdiction of this Court under Article 226 of the Constitution of India, 1950, seeking directions to the respondents to de-freeze/unblock his savings bank account in question with its branch at Shakti Nagar, New Delhi. 2.

Learned counsel for the respondent No. 1/SBI is present on advance notice.

Learned counsel for the petitioner has urged that the petitioner was having a joint account with his wife/respondent No. 2 and they got their matrimonial relationship annulled vide decree of divorce dated 29.10.2001.

It is submitted that all through this time, the petitioner has been operating the bank account in question without any obstacle and now when the matter came up for compliance with KYC5 directions, the account has been frozen.

Learned counsel for the respondents submits that the account has been frozen in terms of Master Circular, prescribing guidelines for compliance with KYC norms dated 01.07.2015.

As evidently, respondent No. 2 has not been operating the bank account in question in the present matter, there is no reason why the bank account of the petitioner be frozen or not be allowed to be operated upon. Hence, the present writ petition is allowed with the directions to the respondent No. 1/bank to de-freeze the bank account of the petitioner and allow him to operate the same on completion of necessary KYC formalities.
