% 16.02.2024 Learned counsel appearing for the petitioner submits, that in view of a learned Sole Arbitrator having been appointed today in ARB.P. No. 1353/2023 titled Mr. Sunil M Nichani & Anr. vs. Mr. Pratap Choudhary & Ors., the present petition may be disposed-of, permitting the petitioner to place this petition under section 9 of the Arbitration & Conciliation Act 1996 ('A&C Act'), as an application under section 17 of the A&C Act before the learned Sole Arbitrator so appointed. It is further submitted that interim relief granted vide last order dated 11.01.2024 may be continued till such time as the learned Sole Arbitrator decides the application under section 17 of the A&C Act. In view of the above, the present petition is disposed-of, permitting the petitioner to place the present petition as an application under section 17 of the A&C Act, which the learned Sole Arbitrator may decide expeditiously, in accordance with law.
Furthermore, it is directed that till such time as the learned Sole Arbitrator decides the application under Section 17 of the A&C Act, the interim relief granted vide para 12 of order dated 11.01.2024, shall continue to remain in force and effect.
The petition stands disposed-of in the above terms. Pending applications, if any, also stand disposed-of.
