Cont.Cas(C) 177/2017 & CM Appl. 7751/2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 11th January, 2017 passed by a Coordinate Bench of this Court in W.P.(C) 1780/2016 whereby respondent-SDMC was directed to deseal Khasra No.30, Saidulajab Mehrauli Badarpur Road, Delhi, forthwith and preferably within two weeks.
It is pertinent to mention that the Appellant Tribunal, MCD, had set aside the sealing order vide judgment and order 20th August, 2007 and had directed the respondent-SDMC to de-seal the property. Issue notice.
Ms. Shobha Gupta, learned counsel accepts notice on behalf of respondents. She, on instructions of respondent No.2 who is personally present in Court, states that the property in question shall be de-sealed today and possession of the same shall be handed over to the petitioner. The statement made by learned counsel for respondents is accepted by this Court and respondents are held bound by the same. Consequently, present contempt petition and application stand disposed of.
In the event, the property is not de-sealed today, petitioner is given liberty to seek revival of the present contempt petition. MANMOHAN, J FEBRUARY 27, 2017 js
