After part arguments, on being pointed out, paragraphs 16 and 17 of the impugned order, learned counsel for petitioner/tenant seeks a passover to obtain instructions from her client.

the admitted rent in the form of occupation charges at a rate of Rs.2000/- per month. Learned counsel for respondent is not averse to the submission and assures that respondent shall not seek execution of the impugned eviction order for a period of three months from today. 4.

Statement of learned counsel for both sides is taken on record to the effect that the petitioner/tenant shall vacate the subject property on or before 15.04.2024 and handover vacant physical possession thereof to the respondent/landlord and till then, the petitioner/tenant shall pay a sum of Rs.2000/- per month to the respondent/landlord towards use and occupation charges, while the respondent shall not seek execution of the impugned eviction order till 15.04.2024.

In view of above submission and assurance of the respondent not to seek execution of the impugned eviction order till 15.04.2024, learned counsel for petitioner on instruction seeks permission to withdraw this revision petition as well as the pending applications. 6.

Accordingly the revision petition as well as the pending applications are dismissed as withdrawn. Parties are bound by their respective statement.
