% 18.12.2017 As per the writ petition, the acquisition proceedings with respect to the land of the petitioner measuring 18 biswas comprised in old Khasra no.2871/2030/1675 (0-18), new Khasra No.1246 situated in the revenue estate of village Mehrauli, New Delhi are deemed to have lapsed as neither possession has been taken nor compensation has been paid to the petitioner. Counter affidavit has not been filed, however, the same has been handed over in the Court today. Counter affidavit has been seen and returned to enable the counsel to file the same in the Registry. As per the counter affidavit, the actual physical possession of the land in question was handed over to the beneficiary department. Para 5 of the counter affidavit states that the compensation was paid to the recorded owner on 18.09.1985. None is present on behalf of the petitioner. None was present on behalf of the petitioner even on the last date of hearing. It seems that the petitioner is not interested in pursuing the matter. Accordingly, writ petition is dismissed for non-appearance and non-prosecution.
