Writ Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner against Order dated 28.02.2024 bearing No.F.10 (3550696)/CJ/Legal/PHQ/2024/14128 passed by Jail Authorities, rejecting the Furlough to the Petitioner.

It is submitted that the sole ground for rejecting the Furlough is the Order dated 16.05.2016 passed in W.P.(CRL.)236/2016 titled as Vikas Yadav vs. State of NCR of Delhi and Order dated 03.07.2023 passed in W.P.(CRL.)697/2022 titled as Budhi Singh vs. NCT of Delhi by this Court. 3.

Learned counsel for the Petitioner submits that this aspect has been clarified by the Division Bench of this Court in Judgment of Budhi Singh (supra) that even if the Appeal is pending before the Apex Court, Furlough can be granted by the Jail Authorities.

In view of the said Judgment, Jail Authorities are directed to consider the Petitioner's Application for Furlough afresh within three weeks. With the aforesaid directions, Writ Petition along with pending Applications are disposed of.
