O R D E R

% 20.02.2017 This writ petition is directed against the failure and refusal to consider the petitioner for promotion to the higher post of Brigadier. The petitioner challenged the action of the respondents by approaching the Armed Forces Tribunal (Principal Bench), New Delhi. The Armed Forces Tribunal did not pass an interim order as prayed for by the petitioner, restraining the concerned respondents from proceeding with the selection for promotion. The Armed Forces Tribunal, however, directed that the selection of junior persons to the applicant, if any, by the Selection Board held on 14-17 February, 2017 would abide by the outcome of the proceedings before the ld. Tribunal.

The petitioner is sufficiently protected. The promotion will abide by the result of the proceedings before the Tribunal. Our interference is not

called for. Ld. Tribunal will decide the application upon affidavits. This writ petition is thus disposed of.
