The learned counsel for the plaintiff, as well as, the defendant nos. 1 to 10 and 12 jointly submit that the matter was referred to the Delhi High Court Mediation and Conciliation Centre, where the parties have arrived at a settlement, terms whereof were reduced into writing in the form of Settlement Agreement dated 19.07.2024, which is on recod. 2.
A perusal of the said settlement shows that an amount of Rs. 1 crore was paid by the aforesaid defendant nos. 1 to 10 and 12 to the plaintiff on 19.07.2024 at the time of signing of the Settlement Agreement and the balance amount of Rs. 12 lacs is payable on or before 18.08.2024. 3.
In so far as the defendant no.11 is concerned, the learned counsel for the plaintiff submits that he is giving up his claim against the said defendant. In view of the above, the learned counsel for the plaintiff wishes to withdraw the present suit and also urges the Court to refund the Court Fees. 5.
Accordingly, the suit is dismissed as withdrawn. 6.
Since the suit has been compromised before the Delhi High Court Mediation and Conciliation Centre, the Registry is directed to issue certificate to the plaintiff for the refund of full amount of Court Fees paid in respect of present suit.
