% 11.04.2017 Parties have settled the matter.

Learned counsel appearing for the petitioner on instructions from the petitioner, who is present in court in person, submits that the petitioner shall vacate the tenanted property/shop No.1321, Bagichi Ram Chander, Sang Trashan, Pahar Ganj, New Delhi-110055 as described in the eviction petition and hand over vacant physical possession of the tenanted premises to the respondent on or before 30.06.2019. The petitioner will also pay the agreed rent to of Rs.200/- per month for the period the premises is in his occupation including arrears, if any, from the date of the eviction order. He will also pay the electricity and water charges for the period the premises is in his occupation. He will also not induct any third party into the premises or cause any wilful damage to the property.

The petitioner shall file an undertaking to comply with the above

terms within two weeks from today. Learned counsel for the petitioner submits that in view of the above, the petitioner does not want to press the present petition.

Learned counsel for the respondent on instructions from the respondent, who is present in court in person, submits that in case the affidavit of undertaking as stated above is filed by the petitioner within two weeks from today the respondent shall not execute the eviction order till 30.06.2019.

Keeping in view the above, the present petition is disposed of. All pending applications also stand disposed of.
