This application is filed seeking leave to prefer an appeal against the order dated 25.09.2014 passed by the learned Single Judge in W.P.(C) No.3797/2014.

The said writ petition was filed by the respondent No.1 herein challenging the show cause notice dated 20.05.2014 as well as Notifications dated 07.01.2011 and 30.12.2013 issued by the Lieutenant Governor of Delhi to the extent it directs private unaided minority schools to admit children belonging to EWS category to the extent of 20% at entry level and provide free-ship to them till completion of their school education. LPA 57/2015

The learned Single Judge disposed of the writ petition by the order under appeal following the judgment of the Supreme Court in Pramati Educational and Cultural Trust & Ors. v. Union of India & Ors.; W.P.(C) No.416/2012 dated 06.05.2014 and set aside the impugned show cause notice and the Notifications to the extent they directed the petitioner/school to admit students in EWS category.

Having heard the learned counsel for both the parties and having regard to the facts and circumstances of the case, we are unable to hold that the appellant, which is a third party to the proceedings and claims to be a Civil Rights Group, is an aggrieved party so as to maintain an appeal under Clause 10 of the Letters Patent. Hence, we decline to grant the leave and accordingly the application is dismissed.

LPA 57/2015 & CM No.1968/2015 (delay in filing) Consequent to the dismissal of the application seeking leave to appeal, this appeal shall stand dismissed.
