O R D E R

% 14.12.2024 This statutory appeal was filed by the appellant/Insurance Company for reduction of the amount of compensation awarded by the learned Tribunal vide award dated 13.12.2014 in the sum of Rs. 31,09,384/- along with interest @ 9% per annum from the date of the filing of the claim petition i.e. 24.12.2011 till realization. It is a matter of record that the appellant/Insurance Company has already deposited 70% of the amount of compensation along with proportionate interest before the learned MACT in terms of order dated 06.02.2015 passed by High Court of Delhi. After having deliberation with the parties, it is agreed that the appellant/Insurance Company shall deposit the balance amount of 30% of the principal award amount along with interest @ 9% p.a. from the date of claim petition i.e. 24.12.2011 till the date of deposit minus lump sum reduction amount of Rs. 2,45,000/-. Accordingly, the Insurance Company is directed to deposit the above mentioned settled amount within a period of five weeks before the concerned Tribunal, failing which it shall be liable to pay interest on the delayed deposit.

The said amount be released to respondents/claimants in such proportions as directed vide the award, subject to fulfillment of all the requisite formalities.

The statutory amount with interest, if any, be refunded to the Insurance Company.
