% 18.01.2019 After some hearing, the counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty file a fresh petition though for similar relief respecting the same criminal complaint case (CC No. 11923/2017) of the respondent involving offence under Section 138, Negotiable Instruments Act, 1881, in view of the subsequent order whereby official liquidator has been appointed and the dismissal of the application for discharge by the Metropolitan Magistrate, by order dated 13.09.2018.

The petition is dismissed as withdrawn with liberty as prayed for, granted.

This renders all pending applications infructuous which stand disposed of.
