At the outset, learned counsel for petitioner in all fairness discloses that now this petition has become not sustainable in view of the judgment of the Full Bench of this Court, rendered in the case titled Dr. Geetanjali Aggarwal vs Dr. Manoj Aggarwal, MAT. APP. (FC) 126/2019 decided on 16.10.2024. It is submitted by learned counsel that the order impugned in the present petition would have to be assailed by way of appeal. 2.

Under these circumstances, as requested, the petition and the accompanying application are dismissed as withdrawn with liberty to file an appeal in two weeks to assail the order impugned in the present proceedings.
