HON'BLE MR. JUSTICE JASMEET SINGH

% 18.11.2024 1.

This is a petition filed under Section 528 of the Bhartiya Nagrik Suraksha Sahita, 2023 seeking quashing of FIR No. 434/2022 dated 05.07.2022 under Section 498A/406/377/34 of IPC PS Jagat Puri, Shahdara, Delhi.

2.

It is stated that the marriage was solemnized between the petitioner No. 1 and respondent No. 2/complainant on 16.02.2021. On 17.01.2022, complainant left the matrimonial home and after sometime, the aforesaid FIR was registered.

3.

The parties have arrived at a settlement on 19.10.2023, wherein the petitioners have undertaken to pay a sum of Rs. 25,35,000/- to the complainant.

4.

The amounts of Rs. 20,000,00/- have been paid and the remaining amount i.e. Rs. 5,35,000 is paid today by Demand Draft No. 504204 drawn The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. on ICICI Bank.

5.

The petitioner is present in Court and is identified by Mr Dubey, learned counsel. The respondent No. 2 is present in Court and is idenfied by SI Sunita, PS Jagat Puri.

6.

The respondent No. 2/complainant i.e. Ms. Palak has no objection to her name being recorded in the petition. She states that the matter has been settled.

7.

I am satisfied that the matter has been settled and the settlement is lawful. Since the parties have arrived at a settlement and no disputes are pending, I am convinced that quashing of such proceedings on account of compromise would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further.

8.

In this view of the matter, there is no reason to continue the proceedings. Hence, the aforesaid FIR and the consequential proceedings arising therefrom are quashed.

9.

The present petition is disposed of.
