$~25 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 1551/2017 & CM APPL. 6981/2017 GHANSHYAM AND ORS ..... Petitioner Through Mr. Anand Nandan, Adv.
versus AIRPORT AUTHORITY OF INDIA AND ANR ..... Respondent Through Mr. Rajan Sabharwal, Adv. for R-1.
Ms. Anjana Gosain, Ms. Rabiya Thakur, Advs. for R-2.
CORAM:
HON'BLE MS. JUSTICE ANU MALHOTRA
O R D E R
% 17.07.2017 It is submitted on behalf of the respondent no. 2 by the learned counsel present that no notification has been issued by the Union of India in terms of Section 10(3) of the Contract Labour (Regulation) and Abolition Act, 1970 in the Airport Authority of India.
In view thereof it is apparent that the prayer made on behalf of the petitioner seeking the respondents to deploy regular employees on the posts on which the petitioners are working with the respondents, once the notification under Section 10(1) of the Contract Labour (Regulation) and Abolition Act, 1970 is issued by the Central Government is admittedly premature. Likewise, the prayer that the respondents be directed to regularize the services of the respondents, once the Notification under Section 10(1) of the Contract Labour (Regulation) and Abolition Act, 1970 be issued to the Central Government is also pre-mature.
The petition is thus dismissed as being pre-mature. However, it is made clear that the observations herein above are not on the merits of the case.
