By the present petition filed under Article 227 of the Constitution of India, the petitioner seeks to impugn the order dated 04.11.2015 by which the defence of the petitioner/defendant was struck of for non-filing of the written statement.

The learned counsel for the petitioner submits that the written statement was not filed as the complete set of paper book was not supplied to him.

The learned counsel for the respondents submits that they deny the contention of the petitioner but have no objection in case the written statement of the petitioner is taken on record subject to payment of cost. 4.

In view of the above, the written statement of the petitioner may be taken on record by the trial court subject to payment of cost of Rs.10,000/-. 5.

Accordingly, a copy of the written statement which is annexed with

the present petition be filed by the petitioner before the concerned trial court within one week from today.

The petition stands disposed of.
