% 18.09.2017 The respondents alongwith the counter affidavit have filed copy of order dated 17th May, 2016 in writ petition (C) No. 3199/2016, Shailendra Kumar versus Union of India and Others.

Counsel for the petitioner states that she was not aware of the aforesaid writ petition as the petitioner had not informed her, about the earlier litigation and challenge.

Order dated 17th May, 2016 records the presence of the petitioner, who was present in person.

Counsel for the petitioner has also stated that the petitioner along with seven others had filed Writ Petition (C) No 1786/2016, which was dismissed

as withdrawn with liberty to prefer a fresh writ petition individually. Be that as it may, in view of the fact that the petitioner had earlier preferred Writ Petition (C) 3199/2016 which stands dismissed after recording detailed reasons, the second writ petition is not maintainable. The present writ petition is accordingly dismissed on the ground of concealment of facts and res judicata.
