The petitioner has approached this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging a summoning order dated 21.03.2025, issued by the Magistrate's Court, in a complaint case [Complaint Case No. 13681/2016] filed by respondent No. 1 under Section 200 of the Code of Criminal Procedure, 1973. 2.

Ms. Mahima Dayani, learned counsel for the petitioner, seeks permission to withdraw this petition, with liberty to approach the revisional Court against the summoning order. She also submits that she will file an application for condonation of delay before the revisional Court, in view of the fact that the petition has been pending before this Court for approximately one year.

In view thereof, the petition, alongwith pending application, is dismissed as withdrawn, without prejudice to the rights and remedies of the petitioner. The revisional Court may also consider the request for condonation of delay in accordance with law.
