% 09.01.2020 I.A.188/2020 This is a joint application filed by the parties under Order XXIII Rule 3 CPC with the following prayers:
"In view of the aforesaid, it is humbly prayed that the Hon'ble court may be pleased to:
i) Take the present application and undertakings on record and pass a decree in terms of the present application with the same forming a part of the decree;
iii) Any other relief which the Hon'ble Court thinks fit and proper in the circumstances of the case."
The application has been signed on behalf of the parties and their counsels. The same is supported by affidavits. Learned counsel for the parties state that the parties have settled their
inter se dispute in terms of paragraphs 3, 4, 5, 7, 8, 9 and 10 of the application. Learned counsel for the parties reiterates that the parties shall be bound by the terms of the settlement. Their statements are taken on record. They also states that the suit be decreed in terms of the paragraphs 3, 4, 5, 7, 8, 9 and 10 of the application. It is ordered accordingly. The settlement being lawful, the suit is decreed in terms of paragraphs 3, 4, 5, 7, 8, 9, 10 of the application. The decree sheet shall be drawn up accordingly.
Application stands disposed of.
The date already fixed stands cancelled.
