This application is filed on behalf of the Petitioner seeking condonation of delay of 31 days in re-filing the petition. 2.

For the reasons stated in the application, the same is allowed. Delay of 31 days in re-filing the petition stands condoned. 3.

Application stands disposed of.

This petition is filed on behalf of the Petitioner under Section 11(6) of Arbitration and Conciliation Act 1996 ('1996 Act') seeking appointment of a Sole Arbitrator to adjudicate the disputes between the parties. 5.

Case of the Petitioner is that a contract was awarded to it by the Respondent on 22.09.2021 for 'protection of DDA land under South Zone' whereby Petitioner was to deploy private security guards for watch and ward of vacant plots/lands on all roads under jurisdiction of South Zone. grievance of the Petitioner is that outstanding dues of the Petitioner have not been released till date and despite repeated requests, Respondent has not convened the Dispute Redressal Committee as per clause 25 of the Dispute Resolution Mechanism. Petitioner sent notice invoking arbitration on 13.02.2025 under Section 21 of the 1996 Act but Respondent did not consent to appointment of an Arbitrator and after passage of 30 days from the date of receipt of the notice, this petition was filed. 6.

Learned counsel for the Respondent, on instructions, while refuting the claims of the Petitioner on merits, does not dispute the existence of an arbitration agreement between the parties and submits that this Court may appoint a Sole Arbitrator.

Accordingly, with the consent of the parties, Ms. Justice Sunita Gupta, former Judge of this Court, (Mobile No. 9910384628) is appointed as the Sole Arbitrator to adjudicate the disputes between the parties. Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre ('DIAC'). Fee of the Arbitrator shall be fixed as per fee schedule under DIAC (Administrative Cost & Arbitrators' Fees) Rules 2018. 8.

Learned Arbitrator shall give disclosure under Section 12 of the 1996 Act before entering upon reference.

It is made clear that this Court has not expressed any opinion on the merits of the case and all rights and contentions of the respective parties are left open.

Petition is disposed of in the aforesaid terms.
