The present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 438 of the Code of the Criminal Procedure, 1973) seeks pre-arrest bail in proceedings emanating from FIR No. 53/2025 registered under Sections 115(2)/126(2)/351(2) of the Bharatiya Nyaya Sanhita, 20231 at P.S. Dwarka, Delhi. 2.
The present FIR was registered pursuant to a complaint alleging that on 4th February, 2025, at about 3:15 PM, the Complainant, Pankaj Kumar, was assaulted by the Applicant near Gate No. 1 of Dakshinayan Apartments, Sector-4, Dwarka. It is alleged that the incident occurred after the 1 "BNS"

Complainant requested stoppage of unauthorized noise-generating work being carried out in the Applicant's basement. The Applicant is stated to have abused and threatened the Complainant and to have physically assaulted him, including by kicking his polio-affected leg, thereby causing serious injury. The incident was allegedly witnessed by staff members of the residential society. On the basis of the Complaint and a preliminary inquiry, the present FIR was registered on 10th February, 2025 under the aforesaid provisions.

As directed by this Court vide order dated 25th August, 2025, the Applicant has duly joined investigation. The matter is still under investigation, however, the counsel for the Applicant undertakes that the Applicant shall be ready and willing to appear before the Investigating Officer ('IO') as and when called for. The said undertaking is taken on record and the Applicant shall be bound by the same. 4.
In view of the aforesaid circumstances, since the Applicant has duly joined the investigation and has undertaken to appear before the Investigating Officer as and when required, and further, as no recovery is to be effected from the Applicant, this Court is inclined to grant pre-arrest bail to the Applicant.

Accordingly, the Applicant, in the event of arrest, is directed to be released on bail on furnishing a bail bond for a sum of INR 25,000/- with two surety of the like amount subject to the satisfaction of the concerned SHO, on the following conditions:
a.
The Applicant shall join and cooperate with the investigation as and when directed by the IO;

b.
The Applicant shall not leave the boundaries of the country without informing the IO/ SHO concerned;
c.
The Applicant shall not contact the witnesses or tamper with the evidence in any manner;
d.
The Applicant shall give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times; 6.
In the event of there being any FIR/DD entry / complaint lodged against the Applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 7.
It is clarified that any observations made in the present order are for the purpose of deciding the present pre-bail application and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.

The application is allowed in the afore-mentioned terms. The pending applications are also disposed of.
