The Writ Petition under Article 226 of the Constitution of India read with Section 528 of BNSS has been filed on behalf of the petitioner seeking the following prayer:

a. Issue a writ in the nature of Mandamus directing the respondent to release the petitioner on regular Parole for a period of Eight Weeks;

Learned ASC (Crl.) for the State submits that the present petition has become infructuous inasmuch the petitioner's representation seeking parole has been positively considered by the competent authority. 3.

At this stage, learned counsel for the petitioner states that he does not wish to press the prayer made in the present petition.
