% 02.01.2018 None is present on behalf of the petitioners today. None was present on the last date of hearing i.e. 20.11.2017 also. The petitioners have filed the present petition under Article 226 of the Constitution of India seeking a direction for return of acquired land as the possession is with the petitioners and the land is lying vacant. It is the case of the petitioners that the compensation has not been paid. According to the counter affidavit filed by the DDA, the physical possession of the land has been handed over to the DDA as far back as in the year 1975. Copies of the possession proceedings have been filed. As per counter affidavit filed by the LAC the compensation for a sum of Rs.49,112.32/- and the enhanced compensation to the tune of Rs.17,119/- has been sent to the Court of Additional District Judge.
Since none is present on behalf of the petitioners today and none was present even on the last date of hearing i.e. on 20.11.2017, it seems that the
petitioners are not interested in pursuing the present petition. The writ petition is dismissed for non-appearance and non-prosecution. G.S.SISTANI, J SANGITA DHINGRA SEHGAL, J JANUARY 02, 2018 rb/
