By way of present petition, the petitioner, who is seeking setting aside of the order dated 05.08.2024 passed by DS-Legal, PHQ, Delhi Prisons vide which his application seeking furlough was declined on account of his late surrender on 03.06.2024 while he was released earlier on furlough, seeks furlough for a period of four weeks.

Learned counsel for the petitioner seeks to explain the aforesaid late surrender by stating that one of the son of the petitioner is a special needs child and one of his daughter has recently become a widow. 3.

Issue notice.

Learned ASC for the State accepts notice and submits that the aforesaid aspects are verified and reference is made to the status report in this regard.

In view of the aforesaid facts and circumstances of the case and considering that the explanation offered for his late surrender has been verified, it is directed that the petitioner be released on furlough for a period The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. of three weeks from the date of his release, subject to his furnishing a personal bond of Rs.5,000/- and deposit of cash security of the like amount to the satisfaction of the concerned Jail Superintendent/Duty J.M./Link J.M./concerned Court and subject to the following conditions :- i) The petitioner shall not leave the Delhi NCR without prior permission of the concerned Court;

ii) At the time of furnishing bail bond, the petitioner would specify the mobile number, which he undertakes to keep operational during the period of his release; iii) In case of change of residential address or contact details, the petitioner shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court. iv) The petitioner shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence;

v) The petitioner shall surrender upon expiry of the furlough period.

The petition is disposed of in the above terms. 7.

Copy of the order be communicated to the concerned Jail Superintendent electronically for information and necessary compliance. 8.
