After hearing arguments for some time, learned counsel for petitioner seeks to withdraw the present petition.

However, he supplements that the learned Trial Court may be requested to dispose of the suit on the basis of the evidence led by the parties, without being influenced by the observations recorded in impugned order. 3.

The impugned order, inter alia, records that there is an attempt on the part of defendant to fill up certain lacunae. 4.

The case is already at the stage of final arguments and the next date before the learned Trial Court is stated to be 27.08.2025. 5.

In view of the above, the present petition is disposed of as not pressed. 6.

All the rights and contentions of the parties are left open. 7.
