By way of the instant application, the applicant seeks grant of anticipatory bail in case arising out of FIR bearing No. 783/2024, registered at Police Station Sultanpuri, Delhi for the commission of offence punishable under Sections 221/121/132//109(1)/310(2)/311/3(5)/317(2) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS').

Briefly stated, the facts of the present case are that on 02.09.2024, on receipt of secret information, accused Alka was apprehended from her house. At about 5:50 PM, when the seizure proceedings were concluded and the raiding team was leaving the spot, they were attacked by family members and relatives of accused Alka by pelting stones at them. The police vehicle was also damaged by them. Raiding team member Head Constable Sanjeev was caught at spot and had been brutally beaten up by them. Local Police staff of P.S. sultan Puri, Delhi was also called at the spot and HC Sanjeev was saved from the clutches of the attackers. Thereafter, the statement of HC Sanjeev was recorded and on the basis of the same, the present FIR was registered against the family members of Alka for causing obstruction in the administration of justice by assaulting the police officials in which one of the police official was badly beaten. Ten persons were arrested and charge-sheet was filed before the Court. The present applicant is the brother of accused Alka namely Sandeep Rana and her nephew Mohit Rana was also named in the FIR and were visible in the CCTV footage.

The learned counsel appearing on behalf of the applicant argues that on the ground of parity, the applicant is entitled to grant of anticipatory bail since co-accused has been granted bail in the present case. It is also argued that the applicant has been falsely implicated in the present case and there is no incriminating material on record against him. It is argued that the applicant is not named in the FIR and he is only named in the disclosure statement of the co-accused. It is also argued that he has clean antecedents and custodial interrogation of the present applicant is not required. Therefore, it is prayed that the applicant be granted anticipatory bail. 7.

the present accused/applicant and when the raiding party was conducting the proceedings, present accused/applicant who is her brother along with the coaccused had brutally assaulted the raiding team members and the victim. 8.
This Court has heard arguments addressed on behalf of both the sides and has perused the material available on record. 9.
After hearing arguments and going through the case file, this Court is of the opinion that in the present case the accused is named in the FIR and in the statement of the victim who was one of the raiding team members clearly mentions that the accused Sandeep Rana who is the brother of accused Alka from whom commercial quantity of heroine was recovered and they had just concluded the seizure proceedings had attacked him continuously along with the other co-accused persons and had beaten him. The accused has not joined investigation and they have brutally attacked and interfered with the official proceedings conducted by a government official. 10.
Considering the overall facts and circumstances of the present case and the fact that the applicant has not joined investigation and is evading arrest despite service of notice by police, no ground for grant of anticipatory bail is made out.

Accordingly, the present application stands dismissed. 12.
