After hearing arguments for some time, learned counsel for petitioner submits that since the impugned order, which has been passed under Order XXXIX Rule 2A CPC is appealable under Order XLIII Rule 1 (r) CPC, he does not press the present petition and seeks liberty to file appropriate appeal i.e. FAO challenging the order dated 09.10.2024. 3.

Resultantly, the present petition is disposed of as not pressed. 4.

Liberty, as prayed for, is granted.
