CORAM:
HON'BLE MR. JUSTICE SANJEEV SACHDEVA
O R D E R
% 26.02.2018 Crl. M.A. No. 3577/2018 (Exemption) Allowed, subject to all just exceptions.
CRL.M.C. 975/2018 1.
The petitioners seek quashing of FIR No. 92 of 2013 under Sections 323/341/308/506/34 of the IPC Police Station Shalimar Bagh, New Delhi, based on a settlement.
2.
The parties are neighbours and the disputes arose on account of a misunderstanding. With the intervention of locals and respectable people of the locality, the parties have entered into a settlement and the settlement deed dated 12.01.2018 has been executed.
3.
Respondent no. 2 is present in person in Court today and is identified by the Investigating Officer. He submits that he has settled the disputes with the intervention of locals and respectable people of the CRL.M.C. 975/2018
locality.
He further submits that he does not wish to press the criminal complaint against the petitioners any further. 4.
In view of the fact that the dispute between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIR and the consequent proceedings emanating there from.
5.
In view of the above, the petitions are allowed. FIR No. 92 of 2013 under Sections 323/341/308/506/34 of the IPC Police Station Shalimar Bagh, New Delhi and the consequent proceedings emanating there from are accordingly quashed.
