The application has been filed to report settlement of the suit between the parties. It is informed that the matter has been settled between the parties and CS(OS) 425/2006 be disposed of in terms of the said settlement.

Let the file of CS(OS) 425/2006 be taken for disposal today. 3.

The application stands disposed of.

The matter is settled between the parties.

A joint application (IA 11406/17) under Order XXIII Rule 3 CPC (Ex.P1) has been filed by the parties to report settlement. I have enquired from the learned counsel for the parties if the matter has been settled amicably. It is informed that the matter has been settled amicably between the parties without any pressure and terms and

conditions of the settlement have been incorporated in the joint application (Ex.P1) for settlement.

Learned counsel for the defendants has no objection to decree the suit in terms of para 4 of the application (Ex.P1).

The Court is satisfied that the matter has been settled between the parties amicably. The compromise (Ex.P1) incorporates the terms and conditions of the settlement and is signed by the authorized representatives of the parties and their counsel. 4.

Accordingly, the suit is decreed.

Terms and conditions incorporated in para 4 of the settlement application (Ex.P1) shall form part of the decree-sheet. Decree-sheet be drawn up accordingly. 5.

Since the matter was settled after the recording of the evidence, Court fee under Section 16 or 16A cannot be refunded as prayed. S.P.GARG, J.
