A Petition under Section 11 of the Arbitration & Conciliation Act, 1996 has been filed on behalf of the petitioner for appointment of the Sole Arbitrator to adjudicate the disputes inter-se the parties. 2.

Learned counsel for the respondent submits that in a reply to the application under Section 21 dated 01.01.2024 for Invoking of Arbitration, the respondent had proposed the name of an Advocate as Sole Arbitrator which was not acceptable to the petitioner.

It is now submitted that the respondent is in the process of appointing an Arbitrator. Clearly, there are disputes between the parties and also a valid Arbitration Agreement. 3.

Considering the totality of circumstances without prejudice to the rights and contentions of the parties to take up their respective claims before the learned Arbitrator, Ms. Shilpa Ohri, Advocate, Mobile No.9871900539, is hereby appointed as the Sole Arbitrator to adjudicate the disputes between the parties.

The parties are at liberty to raise their respective objections before the Arbitrator.

This is subject to the Arbitrator making necessary disclosure as under Section 12(1) of A&C Act, 1996 and not being ineligible under Section 12(5) of the A&C Act, 1996.

The fees of the learned Arbitrator would be fixed in accordance with the Fourth Schedule to A&C Act, 1996 or as consented by the parties. 7.

Learned counsels for the parties are directed to contact the learned Arbitrator within one week of being communicated a copy of this Order to them by the Registry.

A copy of this Order be also forwarded to the learned Arbitrator, for information.
