% 20.02.2018 Crl. M.A.3207/2018 (exemption) Exemption is allowed subject to all just exceptions. CRL. M.C. 870/2018 1.

The petitioner seeks quashing of FIR No.21/2009, under Sections 186/353/332/34 IPC, Police Station Vasant Kunj (North) on the basis of a settlement. The subject FIR was registered nearly two years after the alleged incident.

The allegations in the FIR are that the petitioner obstructed the CRL. M.C. 870/2018

respondent No.2, who was then a Constable in Delhi Police (now an Assistant Sub Inspector), from performing his duties. 3.

Learned counsel for the petitioner submits that the parties have settled their disputes through Settlement Agreement dated 03.02.2018. 4.

The respondent No.2 is present in person, represented by a counsel and is identified by the Investigating Officer. He submits that he has settled the disputes with the petitioner and does not wish to press charges against the petitioner any further and has no objection to the allowing of the present petition and quashing of the subject FIR. 5.

In view of the fact that the parties have settled their disputes and a Settlement Agreement dated 03.02.2018 has been executed between the parties and the fact that the respondent No.2 does not wish to press any charges against the petitioner, in my view, no fruitful purpose would be served in continuing with the criminal proceedings. Further, in view of the fact that the parties have settled their disputes, it would be expedient and in the interest of justice, to quash the subject FIR as well as the consequent proceedings arising there from.

In view of the above, FIR No.21/2009, under Sections 186/353/332/34 IPC, Police Station Vasant Kunj (North) and the consequent proceedings emanating there from are quashed. 7.
