% 13.03.2018 Learned counsel for the respondents has drawn our attention to the orders dated 9.2.2018 and 6.3.2018 passed by the Supreme Court of India in WP(C) No.4677/1995 titled M.C. Mehta v. Union of India & Ors. and submit that the entire issue of modifications/amendments to the Master Plan, including the procedure adopted, is sub judice in the Supreme Court. It is further submitted that it will be inappropriate for the Delhi High Court, in these circumstances, to examine an issue which is substantially an aspect pending before the Supreme Court. At this stage, learned counsel for the petitioner submits that he would withdraw the present writ petition and states that the petitioner

would approach the Supreme Court by way of a writ petition or application. It is submitted that in case the Supreme Court states that the matter should be heard by the Delhi High Court, the petitioner will ask for revival of the writ petition.

Taking the statement on record and in terms of the statement, the writ petition is dismissed as withdrawn, without making any observations. CM No.6758/2018 is also dismissed as withdrawn. SANJIV KHANNA, J CHANDER SHEKHAR, J MARCH 13, 2018 tp
