Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner against Order dated 10.06.2025 passed by learned JMFC-03, Rohini Courts and Order dated 14.01.2025 passed by learned ASJ, Rohini Courts in CRL. REV. No.367/2024 and seeking release of FDR No.459221 dated 23.11.2016 of Rs.12,00,000/- along with interest in favour of the Petitioner.

Learned APP for the State appearing on advance Notice accept Notice. 4.
Learned counsel for the Petitioner seeks release of Rs.12,00,000/-, which had been deposited at the time of granting bail to Naveen Sharma (Respondent No.2 herein).

Subsequently, the Parties have arrived at Mediation Settlement Agreement dated 25.09.2020, wherein, it was agreed that various amounts were to be paid, which stand paid. to be paid to the Complaint on quashing of the FIR. 6.
In view of aforesaid, learned counsel for the Petitioner seeks permission to withdraw the present Petition with liberty to file afresh for quashing of FIR in terms of Mediation Settlement Agreement dated 25.09.2020.

Petition along with pending Applications is dismissed as withdrawn with liberty as prayed for.
