This petition has been filed challenging the Order dated 16.04.2025 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as 'Tribunal') in O.A. No.737/2022, titled Shri Amresh Kumar Tripathi v. Union of India & Ors., whereby the said O.A. filed by the respondent herein was allowed.

The respondent had filed the above O.A., inter alia, challenging the Penalty Order dated 18.02.2021 on the ground that the Union Public Service Commission's (UPSC) advice rendered in the Disciplinary Inquiry Proceedings was not communicated to him prior to the passing of the Impugned Penalty Order. The learned Tribunal, vide the Impugned Order, accepted the said plea of the respondent by placing reliance on the Judgment of this Court in Union of India & Ors. v. Mahender Singh, 2025:DHC:257DB, and quashed the Impugned Penalty Order. 5.
We see no infirmity in the Impugned Order.

The petition is, accordingly, dismissed. The pending application also stands disposed of as infructuous.
