A Petition under Section 528 BNSS has been filed on behalf of the petitioner for quashing of FIR No.532/2021 dated 11.08.2021 under Section 354/354B/323/34 IPC read with Section 10 of POCSO Act registered at Police Station Sadar Bazar.

Briefly stated, on 11.08.2021 the complainant/respondent No.2 had given a complaint to the Police of Police Station Sadar Bazar and got an FIR registered under Sections 354/354B/323/34 IPC read with Section 10 of POCSO Act against the petitioners.

respective persons of the vicinity and they have arrived at a Settlement vide Settlement Deed dated 16.07.2024. It is submitted that they Settlement has been arrived at between them without any force, pressure and coercion and that they undertake to abide by the terms of the Settlement Deed dated 16.07.2024. It is submitted that they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The complainant/respondent No.2 is present in the Court and submits that the dispute between them was on account of Jhuggi and that now the matter stands settled with all the petitioners. She has no objection if the FIR is quashed against the petitioners on account of the settlement already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 532/2021 dated 11.08.2021 registered at Police Station Sadar Bazar, for offences punishable under Sections 354/354B/323/34 IPC read with Section 10 of POCSO Act with all the subsequent proceedings and the charge sheet is hereby quashed qua all the petitioners.

The Petition stands disposed of.
