CRL.M.A. 27134/2024 Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for condonation of delay of 95 days in re-filing the petition. For the reasons stated in the application, delay of 95 days in re-filing the petition is condoned.

Application is accordingly disposed of.

and 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner challenging order dated 22.04.2024 passed by learned ASJ, West District, Tis Hazari courts, Delhi, in Session Case No. 444/2020, whereby charge was directed to be framed against the petitioner alongwith co-accused under Sections 304/34 IPC in FIR No. 132/2020, registered at PS: Khyala.

After partly making submissions, learned counsel for petitioner does not press the petition without prejudice to rights and contentions of the petitioner.
