% 21.07.2025 CM APPL. 42803/2025 By way of the present application filed under section 151 of the Code of Civil Procedure 1908, the applicant/appellant seeks withdrawal of the appeal and a direction for release of the sum of Rs. 5 lacs deposited with the Registrar General of this court to appellant No. 1(b)/Mr. Prashant Singh.

Mr. S.K. Rungta, learned senior counsel appearing for the appellant, submits that the parties have resolved their inter-se disputes through mediation; and though the settlement agreement is not yet on record, the terms thereof have been acted upon, and the appellant seeks leave to withdraw the appeal.

Mr. Rungta further explains, that since the money was deposited in this court by appellant No.1(b)/Mr. Prashant Singh, the refund be made to appellant No.1(b)/Mr. Prashant Singh only. Mr. Lalit Gupta, learned counsel appearing for the respondents concurs in the submissions made.

In view thereof, the application is allowed and disposed-of. RFA 598/2024 6.

In view of the above, the present appeal is disposed-of as withdrawn. 7.

The Registry is directed to release the amount deposited in this court, alongwith interest upto-date in favour of appellant No.1(b)/Mr. Prashant Singh within 02 weeks of being approached for that purpose. 8.

All pending applications, including CM APPL. No. 33147/2025 are disposed-of as withdrawn.

The date of 29.07.2025 and 20.08.2025 given earlier stand cancelled. 10.

As requested by Mr. Gupta, let a copy of the settlement agreement be signed by all parties; and a copy thereof be brought on record.
