% 27.07.2018 In the FIR no.174/2015 of Police Station Maurice Nagar allegations have been made against the petitioner at the instance of second respondent (the first informant of the case) about his involvement in offences punishable under Sections 448/380 of Code of Criminal Procedure, 1973 (Cr.P.C.).
The case is still at the stage of investigation, the report under Section 173 of Cr.P.C. not having been submitted till date. He has approached this Court by the present application seeking anticipatory bail. The interim anticipatory bail was granted by order dated 06.03.2017 subject to conditions specified therein. The said protection was extended by subsequent orders and has continued to operate till date. The parties, in the meanwhile, have entered into a settlement which has resulted in a settlement agreement being executed, in terms of which two civil suits which were filed arising out of the same controversy, have since been decided. In this view, BAIL APPLN. 395/2017
learned counsel for the second respondent submits he has no objection to the prayer to the anticipatory bail as granted by interim order to be made absolute. Ordered accordingly.
