The present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of the Code of Criminal Procedure, 19732) seeks quashing of FIR No. 293/2022 dated 8th March, 2022, registered under Sections 323, 342, 354(B), 506, 509 and 34 of the Indian Penal Code, 18603 at P.S. Okhla Industrial Area, Delhi. 2.
The Complainant, present in person, states that she has once again been deserted by the Petitioners and is presently residing separately. She further submits that she opposes the quashing of the FIR. The Complainant, is visibly distressed and weeping before the Court and prays that strict action be taken against the Petitioner.

The scope of the present proceedings is confined to examining whether there exists a genuine settlement between the parties. noted above, the purported settlement cannot be the basis for this Court to exercise its inherent jurisdiction to quash the FIR. 4.
In light of the above circumstances, counsel for the Petitioners states that he would like to withdraw the present petition with liberty to take recourse to other remedies, as are available under law. 5.
The Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
