This writ petition has been preferred on behalf of the Petitioner under Articles 226/227 of the Constitution of India assailing the transfer order dated 31.05.2024, passed by the Respondents.

Counsels as above accept notice on behalf of the Respondents and oppose the petition on multiple grounds.

After canvassing some arguments, learned counsel for the Petitioner, on instructions from the Petitioner, who is present in Court, seeks to withdraw this writ petition but seeks 02 weeks to join at Ahmedabad. further urged that Petitioner was relieved on 09.08.2024 but has not joined the new place of posting under a bonafide impression that till the decision on his representation against the transfer order, he could continue on the present place of posting, else the purpose of representing was defeated. In view of this, learned counsel submits that a direction be issued to the Respondents not to treat the period between 09.08.2024 till the date of joining at Ahmedabad as period of unauthorized absence.

Writ petition is disposed of as withdrawn, permitting an extended joining time of 02 weeks to the Petitioner. However, considering that Petitioner had filed a representation against the impugned order dated 22.06.2024 and was under an impression that until his representation was decided, he was not required to join his new place of posting as also that he has assailed the order in present petition exercising his right to take recourse to legal remedies, it is directed that if the Petitioner joins the place of posting as per the impugned transfer order within two weeks from today, the period from 09.08.2024 till his joining, shall be adjusted against his authorized leaves and will not be treated as period of unauthorized absence. 8.

Pending applications stand disposed of.
