1. The petitioner, who is serving in the Indian Coast Guard, has approached this Court under Article 226 of the Constitution of India with the grievance that his application dated 27.10.2022 has not been decided by the respondents, whereby he had submitted resignation.

2. At the outset, learned counsel for the respondents, who appears on advance notice, submits that the petitioner's application already stands rejected on 03.07.2023 and hands over a copy of the said order passed by the Joint Director, Coast Guard Headquarters.

3. In the light of the aforesaid stand taken by the respondents, learned counsel for the petitioner does not press the present petition, but seeks liberty to assail the order dated 03.07.2023 as per law.
