The present appeal under Section 96 of the CPC, seeks the following prayers:- "(i) Call for Trial Court Record;

(ii) Allow the Regular First Appeal filed by the Appellants, thereby seting aside the impugned order/judgment dated 03.08.2023 passed by the Court of Ms. Shivali Bansal, ADJ- 03, North District, Rohini Court, Delhi;

(iii) Pass an order thereby waiving of the occupational charges amounting to Rs. 1,96,000/- being imposed upon the Appellants in terms of the order/judgment dated 03.08.2023 passed by the Trial Court as the Appellants have been residing in the suit property being the beneficiares of allotment by the Govt. Department and are belonging to below poverty line;

The present appeal has been filed impugning the order/judgment dated 03.08.2023 passed by the learned Additional District Judge-03, North, Rohini Courts, New Delhi, in Civil Suit no. 84/2019 titled as ''Sh. Surender Gupta vs. Smt. Meera Devi & Ors.", whereby the learned Trial Court granted several reliefs to the plaintiff/respondent herein. The appellants herein are the defendants before the learned Trial Court.

Learned counsel appearing on behalf of the appellants, on instructions from the latter, who appears through video conferencing, seeks leave of this Court to withdraw the present appeal.

The present appeal is dismissed as withdrawn and disposed of accordingly.
