Petitioner and respondent no.2 are claiming rights over the Tehbazari site bearing no. 3911 i.e. shop no. 31 (old shop no.5), near Old Punjab Bus Stand, Fatehpuri, Delhi through one Mr. Ram Prakash. 2.

It appears that respondent no.1 has placed on record the status report which speaks of further verification to be carried out from respondent no.2 i.e. Mr. Ajay Singh Chaudhary.

The fact remains that in case, if such verification is found to be detrimental to the interest of respondent no.2, same may give rise to petitioner establishing his right over the Tehbazari site. 4.

Therefore, we deem it appropriate to dispose of the petition by directing respondent no.1 to proceed in accordance with the status report particularly, the verification as required under paragraph 8 of the said status report, which should be done in a time bound manner. The status report dated 22nd March 2025 placed by respondent no.1 is taken note of. Let the verification in regards to respondent no.2, pursuant to paragraph 8, be completed within a period of 6 weeks from today. 6.

We permit respondent no.2 to appear before the Additional Commissioner, City Zone, ("the Authority") along with his original record for the purpose of extending all possible assistance for verification. 7.

The Authority shall look into the documents submitted by respondent no.2 and pass an appropriate order qua the rights of respondent no.2 in the matter.

Let the aforesaid proceedings be concluded, in any case, within a period of 8 weeks from today.

Petition accordingly stands disposed of.

We make it clear that in case, the order is adverse to the interest of either of the parties i.e. petitioner or respondent no.2, it shall be open for them to take recourse to such remedy, as is permissible and available in law. 11.

This Court has not gone into the merits of the matter. 12.

Needless to clarify, decision taken by the Authority be made available forthwith to respective counsels appearing for parties. 13.

Present petition stands disposed of.

Pending applications, if any, also stand disposed of. 15.
