% 15.03.2018 After some hearing, the learned counsel for the petitioners submitted, on instructions, that he may be allowed to withdraw the present petition and the application filed therewith, he not pressing for any relief at this stage of the proceedings in the civil suit reserving all his contentions to be agitated on merits in the main suit.
The petition and the application filed therewith are dismissed as withdrawn. The interim order in these proceedings shall stand vacated. It is, however, added that while deciding the civil suit on merits, the civil judge will not feel bound by or be influenced by any observations made in the order dated 16.10.2012 whereby the trial court had dismissed the application under Order XXXIX Rule 1 and 2 CPC or the order dated 18.12.2013 passed by the first appellate court in MCA no.5/2013.
