Adjournment is sought on behalf of the counsel for the appellant who is stated to be in Tis Hazari Courts.

The appeal impugns an order dated 26th November, 2014 of Shri Naveen Gupta, Additional Senior Civil Judge, Rohini, Delhi. 3.

The appeal even if maintainable thereagainst has to lie before the Court of the District Judge and not before this Court, the Court of the District Judge being the Court of minimum pecuniary jurisdiction competent to entertain the appeal.

Though notice of the appeal was ordered to be issued and several adjournments have been granted owing to the respondent remaining unserved but since the appeal does not lie before this Court, no purpose will be served by adjourning the appeal as is sought. 5.

The appeal is dismissed with liberty however to the appellant to take appropriate remedies in accordance with law.

No costs.
