O R D E R

% 11.03.2016 This is an application under Section 439 Cr.PC read with Section 37 of the NDPS Act moved by the petitioner for grant of interim bail in Complaint Case No. 8(C), 9A, 22C, 23C & 29 of NDPS Act on the ground of arranging funds for his ailing and infirm wife.

It is submitted by counsel for the petitioner that wife of the petitioner, namely, Mrs. Priyanka Pandey has been advised surgery on 14.03.2016 for which she is required to be admitted in hospital on 12.03.2016. The doctor advised for arranging of two units of blood and an attendant by the side of his wife. It is further submitted that co-accused Deepak Kumar was granted interim bail by this Court on more than one occasion as such there is no legal bar to grant interim bail to the petitioner. It is, therefore, prayed that the petitioner be granted interim bail for a period of six weeks. As per verification report submitted by the respondent, the medical certificate regarding proposed surgery of wife of the petitioner has been verified.

Keeping in view all the facts and circumstances of the case, the petitioner is granted interim bail for a period of two weeks, which shall be effected from the date of release, on executing personal bond in the sum of Rs.

(i) He shall furnish his contact number and address to the Superintendent of Narcotic Control Bureau as well as to the concerned SHO.

(ii) He is further directed not to leave union territory of Delhi during this period.

(iii) On expiry of period of interim bail, the petitioner is directed to surrender before the Superintendent Jail.

It is clarified that in case for some reasons, the surgery of wife of the petitioner does not take place, in that eventuality, he will immediately surrender before the Superintendent Jail, otherwise on expiry of period of interim bail. The application stands disposed of accordingly. A copy of this order be given dasti under the signatures of the Court Master to counsel for the petitioner.
