O R D E R

Petitioner impugns order dated 23.01.2017 whereby petitioner was directed to pay Rs.1,20,000/- per month as interim maintenance and to pay Rs.50,000/- as litigation expenses. 2.

Learned counsel for the parties submit that the petitioner has paid the maintenance upto date.

It is informed that a divorce petition filed by the petitioner is also pending before the Trial Court and has been clubbed with the maintenance petition.

Learned counsel for the parties pray that without prejudice to the rights and contentions of the parties, present petition be disposed of with the following directions:- i) Petitioner shall pay interim maintenance of Rs.1,20,000/- CRL.REV.P. 344/2017

per month till final adjudication of the maintenance petition by the Trial Court;

ii) Trial Court would be free to assess the maintenance based on the evidence led before it without being influenced by this order;

iii) Trial Court shall expedite the trial and endeavour to conclude the same within a period of six months from the next date fixed before the Trial Court.

iv) Trial Court shall endeavour to conclude the divorce petition also within the said period of six months from the next date fixed before the Trial Court.

It would be open to the parties to apply to the Trial Court for advancing of the next date fixed before the Trial Court. The Trial Court would be at liberty to consider the same, keeping in view its board position.

The petition is accordingly disposed of with the above directions. All rights and contentions of parties are reserved. 7.
