% 21.08.2025 1.

The present writ petition has, inter alia, been filed for directions to the respondents to take action against the pubs/bars/restaurants being run in the name of 'CHICA', 'COSY BOX', 'TALK' and 'DIRTY GOOD' at the Musical Fountain and Nature Park, opposite Bhikaji Cama Palace, Block B3, Netaji Nagar, New Delhi, adjoining to the Gurudwara Sri Guru Singh Sabha.

2.

Learned counsel appearing for respondent nos. 1, 3 and 4-Municipal Corporation of Delhi ("MCD"), at the outset, points out that the area in question, where unauthorized construction/encroachment is stated to be existing, is within the jurisdiction of New Delhi Municipal Council ("NDMC"). She, thus, submits that MCD has no role in the present matter. 3.

the MCD, this Court notes that the petitioner has made the complaint to the MCD, with regard to the properties in question. 4.

Clearly, since the MCD does not have jurisdiction over the area in question, the complaint made by the petitioner, is to the wrong authority. 5.

Accordingly, the petitioner is granted liberty to file a representation with the concerned authority, i.e., NDMC, with respect to the grievance as raised in the present writ petition.

6.

In case, the petitioner is still aggrieved by any non-action by the concerned authorities, the petitioner shall be at liberty to seek remedies, in accordance with law.

7.

With the aforesaid directions, the present writ petition, along with the pending applications, is disposed of.
