The petitioner, vide the present petition, seeks issuance of direction to the learned Principal Judge, Family Court, Rohini Court (North) to decide HMA No.561/2018 titled Shakti Rana Vs. Savita in an expeditious and time bound manner.

As per facts, though the marriage was solemnized inter se the parties on 02.06.2013 and there are two children born out of the wedlock, however, due to certain differences and disputes, the respondent left the matrimonial home alongwith the children.

Thereafter, the petitioner was first constrained to file a petition under Section 9 of the Hindu Marriage Act, 1955 (HMA), however, after being faced with different proceedings, the petitioner filed another petition being HMA No.561/2018 seeking a decree of divorce under Section 13(1)(ia) of the HMA, which is pending adjudication before the learned Trial Court. Learned counsel for the petitioner submits that presently though the trial in the said petition is at the stage of recording of petitioner's evidence, however, in order to derail and prolong the Trial, the respondent has been repeatedly changing her counsel as also filing frivolous applications on one pretext or the other.

Be that as it may, considering that two minor children are involved in the litigation inter se the parties, the learned Trial Court, after taking due note and giving proper weightage to the list of proceedings pending before it, is requested to try making an effort for disposing of HMA No.561/2018 as expeditiously and possible, preferably within a period of nine months. 6.
